Clinical Negligence and the Law
In English law, the issue of liability is a subset of professional negligence where, under the Bolam Test, a doctor will be liable unless shown to have acted in accordance with a reasonable body of medical opinion. All family practitioners are insured against medical malpractice claims, and the insurance company will usually contest any legal action taken to claim compensation. Claims for medical malpractice will usually be costly and complex, so always check with your solicitor and a suitable advice service before proceeding.
Damages
Damages may include punitive (exemplary) and compensatory damages; punitive damages are only awarded in the event of wanton and reckless conduct. Compensatory damages may include non-economic damages for the injury itself: psychological and physical harm, such as loss of a limb or organ, loss of vision, the reduced enjoyment of life due to a disability or loss of a loved one, severe pain and emotional distress. Economic damages may also be awarded to compensate for financial losses such as lost earning, medical expenses and life care expenses. These may be assessed for past and future losses.
